"Using agency" means any state agency or local public body requiring services, construction or items of tangible personal property.

ANNOTATIONS

When state fair commission neither "user" nor making "purchase". — State fair commission need not advertise or invite bids from prospective concessionaires because the commission would not be a "user" of the services provided and because the commission is actually licensing, not expending public funds in a "purchase". 1980 Op.
