  1. (a) An owner or operator of a petroleum pipeline is encouraged to create a detailed risk mitigation and response plan for each petroleum pipeline in the watershed of a public surface water supply.

  2. (b) An effective risk mitigation and response plan under subsection (a) of this section:

    1. (1) States clearly each party responsible for implementing the risk mitigation and response plan on behalf of the petroleum pipeline owner or operator; and

    2. (2) Includes at least the following:

      1. (A) Quarterly visual inspection of each petroleum pipeline;

      2. (B) An early notification system for each relevant public water provider;

      3. (C) Plans for the construction of containment berms;

      4. (D) Detailed information on the product being carried in each petroleum pipeline;

      5. (E) The annual training requirements for emergency response personnel; and

      6. (F) A safety-related capital improvement plan that includes without limitation the following:

        1. (i) The removal of aboveground petroleum pipeline crossings;

        2. (ii) The installation of additional valves and valve controls; and

        3. (iii) The construction of additional response structures and facilities.

  3. (c) The petroleum pipeline owner or operator is encouraged to submit any risk mitigation and response plan developed under this section to the Department of Health and the appropriate public water provider for comment.
