Adoption of textbooks and course materials

  1. (a)

    1. (1) For each full semester and collectively for summer sessions, a state-supported institution of higher education in this state shall distribute a list of all textbooks and course materials required or assigned for an undergraduate course by:

      1. (A) Publication on its website; and

      2. (B) Posting at its bookstore.

    2. (2) The list shall be distributed no later than 12:00 noon on:

      1. (A) April 1 for the following fall semester;

      2. (B) November 1 for the following spring semester; and

      3. (C) April 1 for all following summer sessions.

  2. (b) For each textbook or course material the list shall include:

    1. (1) A brief description of the textbook or course material;

    2. (2) The author or authors;

    3. (3) The title and edition; and

    4. (4) Any special instructions or circumstances for the purchase or use of the textbook or course material.

  3. (c) A textbook or course material for an undergraduate course may be adopted after the time specified in subsection (a) of this section for distributing the list if:

    1. (1) The adoption is approved by the department chair and the dean or division head of the affected college; and

    2. (2) The dean or division head of the college forwards to the chief academic officer of the affected state-supported institution of higher education the following information:

      1. (A) A list of each late adoption;

      2. (B) The names of the person or persons responsible for each late adoption; and

      3. (C) A written statement explaining why each adoption was late.
