  1. (a) A person commits the offense of aggravated riot if he or she commits the offense of riot when:

    1. (1) The person knowingly possesses a deadly weapon; or

    2. (2) The person knows that another person with whom he or she is acting possesses a deadly weapon.

  2. (b) Aggravated riot is a Class D felony.
