  1. (a) It is unlawful for any person to solicit a donation or offer to sell any item or service:

    1. (1) On a state highway;

    2. (2) Within ten feet (10') of a state highway, if there is not a sidewalk along the highway; or

    3. (3) Between the highway and a sidewalk, if there is a sidewalk within ten feet (10') of the highway.

  2. (b) A violation of this section is a Class C misdemeanor.
