  1. (a) It is unlawful for any person to sell any horse or mule that has been treated in any manner with a behavior-altering substance within the previous twenty-four (24) hours.

  2. (b)

    1. (1) Notwithstanding any other law to the contrary, a buyer may rescind the sale of a horse or mule and receive full repayment of any moneys paid if the horse or mule has been treated with a behavior-altering substance within twenty-four (24) hours of the sale.

    2. (2) However, if the expiration of the twenty-four (24) hours falls on a weekend or holiday, the right to rescind extends through the next business day following the weekend or holiday.

  3. (c) Any violation of a provision of this section is a Class A misdemeanor.

  4. (d) This section does not apply to any horse claimed in a claiming race at a licensed racetrack under the jurisdiction of the Arkansas Racing Commission if the treatment otherwise subject to this section consists only of a medication that may be administered to the horse without violating any applicable rule of the commission.
