  1. (a) A person commits the offense of unlawful removal of a theft detection device if the person knowingly removes a theft detection device from merchandise prior to purchase with the intent to commit theft or retail theft.

  2. (b)

    1. (1) The unlawful removal of a theft detection device is a Class A misdemeanor.

    2. (2) A subsequent violation of this section is a Class D felony.
