Removal of security freeze

  1. (a) A consumer reporting agency shall remove or temporarily lift a security freeze placed on the credit report of a consumer in the following cases:

    1. (1) Upon the consumer's request under § 4-112-104 or § 4-112-106; or

    2. (2) If the credit report of the consumer was frozen due to a material misrepresentation of fact by the consumer.

  2. (b) If a consumer reporting agency intends to remove a security freeze upon a credit report of a consumer and is not doing so at the request of the consumer, the consumer reporting agency shall notify the consumer in writing at least three (3) business days before removing the security freeze on the credit report of the consumer.
