Upon creation of a regional mobility authority:

  1. (1) The regional mobility authority and its members shall:

    1. (A) Constitute a public corporation; and

    2. (B) Have perpetual succession; and

  2. (2) The regional mobility authority and its members may:

    1. (A) Contract and be contracted with;

    2. (B) Sue and be sued in tort to the extent that it has expressly waived liability in writing; and

    3. (C) Have and use a common seal.
