Suspension of registration

  1. (a)

    1. (1) The Department of Finance and Administration shall suspend the motor vehicle registration of any motor vehicle determined to be in violation of § 27-22-104 or this subchapter.

    2. (2) Suspension will occur regardless of whether:

      1. (A) The owner of the motor vehicle acquires the required liability insurance policy after the date of verification; or

      2. (B) The owner of the motor vehicle terminates ownership of the motor vehicle.

  2. (b) The department or a designated third party will provide notification of the suspension to the owner of the motor vehicle.

  3. (c) In the case of a violation, the department shall terminate the suspension upon payment by the owner of the motor vehicle of a reinstatement fee of one hundred dollars ($100) and submission of proof of current insurance as verified through the online insurance verification system.

  4. (d) The reinstatement fee collected by the department shall be distributed under § 27-16-808.

  5. (e) All officials authorized by law to register motor vehicles, issue motor vehicle license plates, and to perform other duties in connection with the issuance of motor vehicle license plates shall refuse to register or re-register a motor vehicle or refuse to transfer the license plates if the registration is suspended.

  6. (f) Information regarding the motor vehicle registration suspension or reinstatement status of a person is confidential and shall be released only to the person who is the subject of a suspension or possible suspension, or to law enforcement agencies, courts, and other governmental entities, including officials responsible for the issuance of license plates, as necessary in the administration of the provisions of this chapter.
