As used in this subchapter, unless the context otherwise requires:

  1. (1) “Commissioner” means the Secretary of the Department of Finance and Administration acting in his or her capacity as Commissioner of Motor Vehicles of this state;

  2. (2) “Director” means the Director of the Office of Driver Services;

  3. (3) “Driver” means the same as provided in § 27-16-104;

  4. (4) “Serious accident” means:

    1. (A) A reportable accident in which the driver is found at fault; and

    2. (B) The accident is placed on the driver's records by the Office of Driver Services; and

  5. (5) “Serious traffic violation” means any violation where the driver's privilege to operate a motor vehicle has by court order or by administrative action been withdrawn or any violation in which a driver has been found guilty of:

    1. (A) Any alcohol-related moving traffic violation;

    2. (B) Any seat belt violation;

    3. (C) Any commercial motor vehicle violation;

    4. (D) Driving fifteen (15) or more miles per hour over the speed limit;

    5. (E) Reckless driving;

    6. (F) Negligent homicide;

    7. (G) Using a vehicle to commit a felony;

    8. (H) Failure to carry liability insurance;

    9. (I) Leaving the scene of an accident;

    10. (J) Evading arrest;

    11. (K) Fleeing by use of an automobile;

    12. (L) Unsafe driving;

    13. (M) Hazardous driving;

    14. (N) Prohibited passing;

    15. (O) Passing stopped school bus;

    16. (P) Careless or negligent driving;

    17. (Q) Failure to obey a traffic signal or device;

    18. (R) Failure to obey a railroad crossing barrier;

    19. (S) Racing on a highway;

    20. (T) Driving with a suspended, revoked, or cancelled license; or

    21. (U) Driving the wrong way down a one-way street.
