The Director of Arkansas Tobacco Control and the Arkansas Tobacco Control Board may determine the following in accordance with this subchapter:

  1. (1) The number of permits to be granted in the state;

  2. (2)

    1. (A) The locations thereof.

    2. (B) However, a retail, wholesale, or manufacturer permit shall not be issued to a residential address or for an address not zoned appropriately for the business seeking to secure the permit; and

  3. (3)

    1. (A) The persons to whom they are to be granted.

    2. (B) However, a permit shall not be issued to:

      1. (i) A person who has pleaded guilty or nolo contendere to or been found guilty of a felony; or

      2. (ii) A business owned or operated, in whole or in part, by a person who has pleaded guilty or nolo contendere to or been found guilty of a felony.

    3. (C) Arkansas Tobacco Control shall conduct a criminal justice background check on each permit applicant and application, utilizing its Arkansas Crime Information Center access as a law enforcement agency, in accordance with §§ 12-12-1008 — 12-12-1011.
