  1. (a) It shall be unlawful for any person, firm, or corporation to operate a plant producing, manufacturing, processing, freezing, or packaging mellorine or mellorine mix without having first secured a permit signed by the Secretary of the Department of Health and bearing the seal of his or her office. The permit shall be displayed conspicuously at the place of business.

  2. (b) Permits shall be issued for one (1) year and shall be in effect from April 1 through March 31 of each year and shall be cancelled, withdrawn, or suspended by the State Board of Health for failure to comply with any of the provisions of this subchapter after due notice in writing has been given and the licensee has been granted a hearing.

  3. (c) Any licensee whose permit has been cancelled, withdrawn, or suspended as provided in this section shall have the right of appeal from the action of the board to the circuit court of the county of his or her residence.

  4. (d) The secretary shall collect for the permits, and all funds collected by the secretary under the provisions of this subchapter shall be deposited into the State Treasury.
