Board of Developmental Disabilities Services — Powers and duties

  1. (a) The Board of Developmental Disabilities Services:

    1. (1) Shall:

      1. (A) Have charge of the properties used for the purposes of the human development centers;

      2. (B) Supervise:

        1. (i) Appointment of employees;

        2. (ii) Performance of duties by employees, including off-premises assignments for educational or training purposes;

        3. (iii) Removal of employees; and

        4. (iv) Fixing of employee compensation; and

      3. (C) Supervise expenditures of the human development centers; and

    2. (2) May:

      1. (A) Accept and hold in trust real, personal, or mixed property received by grant, gift, will, or otherwise;

      2. (B) Purchase land or receive grants or gifts of land and take deeds therefor in the name of the State of Arkansas;

      3. (C) Accept grants or gifts of money from any source whatever and use the money for any of the powers and purposes of the board; and

      4. (D) Take all action and execute all documents necessary or desirable to carry out the powers and purposes of the board.

  2. (b) The board may make rules regarding the care, custody, training, and discipline of individuals with intellectual and developmental disabilities in the human development centers or receiving services for individuals with intellectual and developmental disabilities and respecting the management of the human development centers and the affairs as the board may deem necessary or desirable to the proper performance of the powers and purposes of the board.

  3. (c) The board is prohibited from promulgating any rule that would set the salary of any employee at the local level unless specifically required to do so by the United States Government.
