As used in this subchapter:

  1. (1) “Council” means the State Interagency Council;

  2. (2) “Developmental delay” means a child is delayed in any one (1) or more of the following areas:

    1. (A) Physical development;

    2. (B) Cognitive development;

    3. (C) Language and speech development;

    4. (D) Psycho-social development; or

    5. (E) Self-help skills;

  3. (3) “Early intervention services” means developmental services which:

    1. (A) Are provided under public supervision through licensure or for accreditation by the appropriate state agency;

    2. (B) Are provided at no cost except when federal or state law, rules, or regulations provide for a system of payments by families, including a schedule of sliding fees;

    3. (C) Are designed to meet the developmental needs of an infant with disabilities or a toddler with disabilities in any one (1) or more of the following areas:

      1. (i) Physical development;

      2. (ii) Cognitive development;

      3. (iii) Language and speech development;

      4. (iv) Psycho-social development; or

      5. (v) Self-help skills;

    4. (D) Meet the standards of the state, including the requirements in this section;

    5. (E) Include:

      1. (i) Family training, counseling, and home visits;

      2. (ii) Special habilitation and education instruction;

      3. (iii) Speech pathology and audiology;

      4. (iv) Occupational therapy such as fine motor skills;

      5. (v) Physical therapy;

      6. (vi) Psychological services;

      7. (vii) Case management services at the service delivery level;

      8. (viii) Medical services for diagnostic or evaluation purposes;

      9. (ix) Early identification, screening, and assessment services; and

      10. (x) Health services necessary to enable the infant or toddler to benefit from other early intervention services;

    6. (F) Are provided by qualified personnel, including:

      1. (i) Certified special educators or training technicians supervised by special educators;

      2. (ii) Speech and language pathologists and audiologists;

      3. (iii) Occupational therapists;

      4. (iv) Physical therapists;

      5. (v) Psychologists;

      6. (vi) Social workers;

      7. (vii) Nurses;

      8. (viii) Nutritionists; and

      9. (ix) Physicians; and

    7. (G) Are provided in conformity with an individualized family service plan adopted in accordance with this subchapter; and

  4. (4) “Infants and toddlers with developmental delays” means individuals from birth through two (2) years of age, inclusive, who need early intervention services because they:

    1. (A) Are experiencing developmental delays as measured by appropriate diagnostic instruments and procedures in one (1) or more of the following areas:

      1. (i) Cognitive development;

      2. (ii) Physical development;

      3. (iii) Language and speech development;

      4. (iv) Psycho-social development; or

      5. (v) Self-help skills; or

    2. (B) Have a diagnosed physical or mental condition which has a high probability of resulting in developmental delay or are at risk of having substantial delays if early intervention services are not provided.
