  1. (a) The circuit court may appoint any licensed nursing home administrator or any qualified person as a receiver who does not have a conflict of interest.

  2. (b) The Department of Human Services shall maintain a list of qualified persons to be furnished to the court. Preference shall be given to persons with experience in delivery of healthcare services and operation of long-term care facilities.

  3. (c) No person may be considered to be qualified to be a receiver who:

    1. (1) Is the owner, licensee, or administrator of the facility;

    2. (2) Is affiliated with the facility;

    3. (3) Has a financial interest in the facility; or

    4. (4) Has owned or operated a facility that has been ordered into receivership.
