The Law Enforcement Support Office may:

  1. (1) Cooperate with the United States Government under 10 U.S.C. § 2576a in the transfer of excess military property to state and local law enforcement agencies:

    1. (A) Whose primary function is the enforcement of applicable federal, state, and local laws; and

    2. (B) Whose compensated law enforcement officers have powers of arrest and apprehension, including without limitation counter-drug and counter-terrorism activities;

  2. (2) Take any action necessary to the proper administration of the acquisition and the distribution of excess military properties to eligible claimants in this state, with distribution to be in accordance with the appropriate controlling federal statutes;

  3. (3) Establish service charges in an amount necessary to cover the expenses of the Department of Public Safety incurred in administering this section; and

  4. (4) Take action as necessary to collect service charges and, from any state moneys over which the department has control, withhold funds necessary to pay an amount owing by a state or local law enforcement agency.
