  1. (a)

    1. (1) A ginner holding a lien under § 18-48-505 and this section may hold the cotton and seed for thirty (30) days, unless his or her claim is paid sooner.

    2. (2) After that time the lienholder may sell it at the best obtainable price on the market, at private sale, and from the proceeds pay his or her just debt and turn the residue over to the owner of the cotton or seed.

    3. (3) If the cotton or seed is gone from the lienholder's possession, he or she may enforce his or her lien before the court, in the manner provided by law for the enforcement of laborers' liens upon the product of their labor.

  2. (b) The lien created by § 18-48-505 and this section shall be enforced within six (6) months after the cotton is ginned, but not thereafter.
