  1. (a) The business of each licensee shall be operated under the direction and control of at least one (1) manager.

  2. (b) A person shall not act as a manager of a licensee or private business until the person has:

    1. (1) Demonstrated the person's qualifications by a written examination; and

    2. (2) Made a satisfactory showing to the Director of the Division of Arkansas State Police that the person has the qualifications prescribed by this chapter.

  3. (c) It is unlawful for an individual to make application to the director as manager or to serve as manager of an investigations company, security services contractor, private business, or alarm systems company unless the individual intends to maintain a supervisory position on a daily basis for the investigations company, security services contractor, private business, or alarm systems company.

  4. (d)

    1. (1) If a manager who has qualified as provided in this section ceases to be manager for any reason, the licensee shall notify the director in writing within fourteen (14) days from the cessation of the manager.

    2. (2) If notice under subdivision (d)(1) of this section is given, the license shall remain in force for a reasonable length of time to be determined by the rules of the director and pending the qualification of another manager.

    3. (3) If the licensee fails to provide the notice under subdivision (d)(1) of this section to the director within the fourteen-day period, the licensee's license may be subject to suspension, a fine, or revocation.
