  1. (a)

    1. (1) It is a Class C misdemeanor for any individual to:

      1. (A) Practice orthotics, prosthetics, or pedorthics in this state unless he or she is licensed under this chapter;

      2. (B) Hold himself or herself out as being able to practice orthotics, prosthetics, or pedorthics in this state;

      3. (C) Dispense an orthosis, a prosthesis, or a pedorthic device unless he or she is licensed under this chapter;

      4. (D) Represent himself or herself to the public by title or description of services that includes any of the following terms unless he or she is licensed under this chapter:

        1. (i) “Orthotic”, “orthotist”, “brace”, or a similar title or description of services;

        2. (ii) “Pedorthic”, “pedorthist”, or a similar title or description of services; or

        3. (iii) “Prosthetic”, “prosthetist”, “artificial limb”, or a similar title or description of services;

      5. (E) Practice orthotics, prosthetics, or pedorthics during the time his or her license is suspended; or

      6. (F) Otherwise violate any provisions of this chapter or rules promulgated under this chapter.

    2. (2) Each day an offense under this section continues is a separate offense.

  2. (b) The Arkansas Orthotics, Prosthetics, and Pedorthics Advisory Board and the Department of Health shall assist the prosecuting attorney in the enforcement of this chapter.
