  1. (a) If a victim is a minor or is incapacitated, incompetent, or deceased, a member of the victim's family may exercise the rights of the victim under this subchapter.

  2. (b) If more than one (1) member of the victim's family attempts to exercise those rights, the court may designate which of them may exercise those rights.
