  1. (a) The following may take bail:

    1. (1) A judge, magistrate, or clerk of the court;

    2. (2) A sheriff or deputy sheriff with respect to any person committed to the common jail of the county;

    3. (3) Any law enforcement officer designated by a municipal police department with respect to any person committed to a municipal jail; and

    4. (4) A law enforcement officer making an arrest as authorized under § 16-81-109.

  2. (b) A constable shall not take bail.
