  1. (a) Any city of the first or second class desiring to avail itself of the benefits of this subchapter, by a majority vote of the elected and qualified members of the city council, may enact an ordinance creating a recreation commission to be composed of five (5) citizens who are qualified electors of the municipality and, by affirmative vote of three-fourths (¾) of the elected and qualified members of the city council, may repeal the ordinance creating the commission.

  2. (b) The commissioners shall be appointed by the mayor and confirmed by a majority vote of the duly elected and qualified members of the city council and shall hold office for a term of five (5) years; however, the first commissioners to be appointed and confirmed shall serve for terms of one (1), two (2), three (3), four (4), and five (5) years, respectively, to be designated by the mayor and city council. Thereafter, upon the expiration of their respective terms, commissioners appointed by the mayor and approved by a majority vote of the city council shall each be appointed for a term of five (5) years.

  3. (c) In the event of a vacancy occurring on the commission, it shall be filled by appointment by the mayor, subject to the approval of a majority vote of the duly elected and qualified members of the city council.

  4. (d) Each commissioner shall file the oath required by law in the State of Arkansas of public officials.

  5. (e)

    1. (1) Any city of the first or second class which has previously created or which may create a city recreation commission, as authorized in this subchapter, is authorized, by ordinance of the governing body of the city, to increase the membership of the commission from five (5) members to seven (7) members. The ordinance enlarging the commission may provide that the two (2) additional members of the commission are not required to be qualified electors of the municipality.

    2. (2) When any city enacts an ordinance increasing the membership of the city recreation commission from five (5) members to seven (7) members, as authorized in this subsection, one (1) of the additional members first appointed shall serve for a term of four (4) years and one (1) shall serve for a term of five (5) years, and their successors shall be appointed for terms of five (5) years.

  6. (f) Upon the appointment of the commissioners as provided in this section, the mayor and city council shall execute such instruments and enact such measures as may be necessary to vest complete charge of the municipally owned recreational park in the commissioners.

  7. (g) Any commissioner appointed by the provisions of this section may be removed for cause upon a two-thirds (2/3) vote of the duly elected and qualified members of the city council.
