As used in this subchapter:

  1. (1) “Agency” means the Arkansas Arts Council established in this subchapter. The agency shall include the advisory council and the position of executive director as established in this subchapter;

  2. (2) “Arts” includes, but is not limited to:

    1. (A) Instrumental and vocal music;

    2. (B) Dance;

    3. (C) Drama;

    4. (D) Painting;

    5. (E) Sculpture;

    6. (F) Creative writing;

    7. (G) Architectural and allied fields;

    8. (H) Graphics;

    9. (I) Folk art;

    10. (J) Porcelain art;

    11. (K) China painting;

    12. (L) Craft art;

    13. (M) Industrial design;

    14. (N) Costume and fashion design;

    15. (O) Motion pictures;

    16. (P) Television;

    17. (Q) Radio;

    18. (R) Tape and sound recordings; and

    19. (S) The arts related to the presentation, performance, execution, and exhibition of such major art forms;

  3. (3) “Group” includes any state or other public agency and any nonprofit society, institution, organization, association, museum, or establishment in Arkansas, whether or not incorporated;

  4. (4) “Office” means the Arkansas Arts Council established in this subchapter. The office shall include the advisory council and the position of executive director as established in this subchapter;

  5. (5) “Production” means:

    1. (A) A play, with or without music;

    2. (B) A ballet;

    3. (C) A dance or choral performance;

    4. (D) A concert;

    5. (E) A recital;

    6. (F) An opera;

    7. (G) An exhibition;

    8. (H) A reading;

    9. (I) A motion picture;

    10. (J) Television;

    11. (K) Radio;

    12. (L) A tape or sound recording; and

    13. (M) Any other activity involving the execution or rendition of the arts and meeting any standards approved by the agency; and

  6. (6) “Project” means:

    1. (A) A program organized to carry out the purposes of this subchapter, including a program:

      1. (i) To foster artistic creativity;

      2. (ii) To commission works of art;

      3. (iii) To create opportunities for individuals to develop artistic talents when carried on as a part of a program otherwise included in this definition; and

      4. (iv) To develop and enhance public knowledge and understanding of the arts and humanities; and

    2. (B) “Project” also includes, when appropriate:

      1. (i) The rental, purchase, renovation, or construction of a facility;

      2. (ii) The purchase or rental of land; and

      3. (iii) The acquisition of equipment, supplies, materials, and other personal property.
