As used in this subchapter:

  1. (1) “Board” means the Board of Corrections;

  2. (2) “County backlog” means those inmates sentenced to the Division of Correction who are being housed in the county jails until space is available in a prison;

  3. (3) “Prison” means a correctional facility operated by the division under the supervision and direction of the board;

  4. (4) “Prison system” means the prison facilities of the division; and

  5. (5) “Rated capacity” means the actual available bed space in the prison system as certified by the board, subject to applicable federal and state laws and the rules and regulations adopted pursuant to those laws.
