  • (a) At the head of the Department, there shall be a Commissioner of Education, hereafter in this chapter referred to as the “Commissioner”.

  • (b) The Commissioner shall be appointed by the Governor, with the advice and consent of the Legislature, and shall hold office during the continuance in office of the Governor by whom he is appointed and until his successor is appointed and qualified, unless sooner removed by the Governor.

  • (c) The Commissioner shall be a citizen of the United States, shall be a graduate of an accredited college or higher institution of learning of recognized standards, shall possess at least a master's degree and shall have had at the time of his appointment at least four years experience in the field of education.

  • (d) The Department shall be administered under the supervision and direction of the Commissioner.

  • (e) The Commissioner shall employ into career service positions pursuant to chapter 25 of this title, such teachers and other employees, as necessary, and such appointments are effective upon the Commissioner's appointment.
