Nongovernment facilities; amount of training limited

  • (a) The training of employees, by, in, and through nongovernment facilities under this subchapter is subject to the following limitations:

    • (1) The number of man-years of training for an agency in a fiscal year may not exceed one percent of the total number of man-years of employment for the agency in the same fiscal year as disclosed by the agency budget estimates for the year, or two man-years, whichever is greater.

    • (2) An employee having less than one year of current, continuous service is not eligible for training unless the head of his agency, with the concurrence of the Director of Personnel, determines that training for the employee is in the public interest.

    • (3) The time spent by an employee in training may not exceed one year in the first five-year period and in each subsequent 10-year period of his continuous or noncontinuous service in the Government.

  • (b) The Director of Personnel, with the approval of the Governor, may prescribe other limitations concerning the time which may be spent by an employee in training.

  • (c) On recommendation of the head of an agency, the Director of Personnel may, with the approval of the Governor, waive all or any of the limitations covered by subsection (a) of this section with respect to that agency or part thereof or one or more employees therein. The Director of Personnel, in the public interest, may, with the approval of the Governor, reimpose all or any of the limitations so waived.
