  • (a) Whenever wildlife is damaging crops or fruit trees, the owner or lessee of the lands on which such damage is done, may report such fact to the Commissioner for investigation. If the Commissioner finds that wildlife is responsible for the damage reported, and that the damage is substantial, he may authorize the owner or lessee or another person to kill such wildlife when it is found upon the premises and in the act of further injuring such crops or fruit trees.

  • (b) The carcass of every animal or bird so killed shall be the property of the person whose crops or fruit trees are so damaged.

  • (c) Any wildlife killed under the provisions of this section shall not be charged against the bag limits prescribed by this chapter.
