Any employee of the Government of the United States Virgin Islands in the classified service who, while so employed, is elected to the Legislature of the Virgin Islands, is entitled to return to the classified service upon his termination from the Legislature. Such employee shall be returned to the classified service within fifteen days after his written notice to the Director of Personnel of his intent to return; Provided, That such written notice is given to the Director within six months after such employee's termination from the Legislature. An employee who elects to return to the classified service pursuant to this section shall retain the rights and privileges of his employment accrued prior to his election to the Legislature including, but not limited to, sick leave, annual leave, tenure, and rights to promotion. The employee shall be returned to the classified service in a position not less than the grade and position he held prior to his service in the Legislature.
