  • (a) The fire service of the Virgin Islands shall be under the supervision of the Director, Virgin Islands Fire Service.

  • (b) The organization of the fire service of the Virgin Islands within the Office of the Governor shall be in accordance with rules and regulations promulgated by the Director, Virgin Islands Fire Service and approved by the Governor.

  • (c) There shall be a fire chief for the District of St. Thomas-St. John and a fire chief for the District of St. Croix. There shall also be a deputy fire chief for the Island of St. Thomas, a deputy fire chief for the Island of St. Croix, and a deputy fire chief for the Island of St. John who shall be a resident of St. John, all of whom shall be appointed by the Governor.

  • (d) The Director shall establish an Arson Prevention and Investigation Unit within each fire district for the purpose of enforcing the provisions of the Territorial Fire Prevention Code and such other rules and regulations that will aid in the prevention of fires. The aforesaid unit shall also investigate all cases of suspected arson, shall perform such other duties as prescribed by the Director, and shall seek the assistance of the United States Attorney, the U.S. Virgin Islands Police Department (V.I.P.D.) or the Department of Justice as deemed necessary. Each Fire Prevention and Investigation Unit shall be staffed by one District fire marshal, several fire inspectors, and such deputy marshals and deputy inspectors I, II, III as determined by the Director. The fire marshal, fire inspectors and deputies shall have specialized training in arson and investigation, which training must be certified by the Director.

  • (e) The fire marshal, fire inspectors and deputies shall be authorized to enter business premises and inspect said premises for any violations to the fire code. If the marshals or inspectors determine that there are violations which present an imminent fire hazard, the offending businesses will be given 72 hours to correct the violations. Failure to correct the violations shall result in the closing of the business by the Director of the Virgin Islands Fire Services. The businesses will only be opened upon the issuance of a certificate of compliance by the Fire Director to the Department of Licensing and Consumer Affairs.
