(a) Unless otherwise prohibited by law, the Police Department shall make available to the Department of Health and the Department of Human Services, at no cost as determined by the Virgin Islands Police Department, access to the Virgin Islands Police Department database; or
(b) The Virgin Islands Police Department and the Department of Health may negotiate and enter into a contract that specifies the method and terms upon which the costs associated with accessing the databases are allocated between the respective departments. The contract may not contain provisions inconsistent with any law that prescribes the extent to which an applicant for licensure, a permit, or certification, or employees, or volunteers shall or shall not pay for a criminal record background check.
