  • (a) Any person, against whom the Commissioner has taken action or made a final determination relative to the administration or enforcement of the provisions under this chapter, may file an appeal with the Superior Court of the Virgin Islands. Within fifteen (15) days after receipt of a copy of the order or other final determination, or after service of notice thereof, the appellant or his attorney shall serve a notice of appeal on the Commissioner and the Attorney General; provided, that during the fifteen (15) day period, the Court may for good cause shown extend the time for a period not to exceed an additional thirty (30) days. In the notice of appeal, the appellant shall refer to the action of the Commissioner appealed from, and shall specify the grounds of appeal including the points of law and facts which the appellant asserts or questions. The appellant or his attorney shall file with the Clerk of the Court a copy of the original notice of appeal with proof of service within fifteen (15) days of the service of the notice and thereupon the Court shall have jurisdiction of the appeal. The service of the notice of appeal does not act as a stay of enforcement of the Commissioner's final order or final determination unless so ordered by the Court.
