Discharge of defendant

  • If from the examination it appears that there is no good reason to fear the commission of the crime alleged to have been threatened, the person complained of shall be discharged. The order for the discharge shall be indorsed upon the warrant and signed by the judge with his title of office, and may be to the following effect:

“There being no good reason shown to fear the commission of the crime within mentioned by the within named I order him to be discharged.”
