  • (a) All administrative decisions of the Department under this chapter are subject to judicial review.

  • (b) Any person aggrieved by a final decision or action of the Department under this chapter is entitled to judicial review of the decision or action by filing an appeal with the Superior Court of the Virgin Islands no later than 30 days after the date of the action or decision complained of. Upon the appeal, the determinations of the Department as to questions of fact are deemed final in the absence of conclusive showing to the court of fraud or misrepresentation. An appeal under this section does not operate to stay the action of the Department, unless ordered by the court.
