(a) Whenever it appears that a person has violated or is violating or threatening to violate any provision of this chapter or of any rule, regulation, or standard of the Department, the Department may cause a civil suit to be instituted in the Superior Court of the Virgin Islands for injunctive relief, including temporary restraining orders, to restrain the person from continuing the violation or threat of violation, or for the assessment and recovery of a civil penalty of not more than $1,000 for each day of violation and for each act of violation, as the court may deem proper, or for both injunctive relief and civil penalties. Upon application for injunctive relief and a finding that a person is violating or threatening to violate any provision of this chapter or of any rule, regulation, standard, or order of the Board of Social Welfare, the Superior Court shall grant the injunctive relief the facts may warrant.
(b) At the request of the Department, the Attorney General shall institute and conduct a suit in the name of the Territory of the Virgin Islands for injunctive relief or to recover the civil penalty, or for both injunctive relief and penalty, as authorized in subsection (a) of this section.
