  • (a) No employer of a person whose income is subject to an income withholding order may discharge, refuse to employ, or take disciplinary action against such person because of the income withholding order. Any employee who is discharged, denied employment, or disciplined because of an income withholding order is entitled to damages suffered, plus employment or reinstatement, plus attorney's fees and costs incurred.

  • (b) Any employer that discharges, refuses to employ, or takes disciplinary action against a person because of an income withholding order shall be fined not less than five hundred dollars ($500) but not more than one thousand dollars ($1,000) and no portion of the minimum fine may be suspended.
