(a) A night club license shall be issued to all qualified applicants for the purpose of operating a night club as defined in section 351a of this title. The annual fee for a night club license shall be $250.
(b) No night club license shall be issued for the operation of any night club that is less than one hundred (100) feet from a church. This subsection shall not apply to any night club in operation prior to passage of this subsection.
