(a) “Access” means the physical characteristics of a place which allows persons with functional limitations caused by impairments of sight, hearing, coordination or perception or persons with semiambulatory or nonambulatory disabilities to enter, circulate within and leave a public building and to use the public toilet facilities therein without assistance.
(b) “Public building” means any structure erected to provide access thereto or egress therefrom by members of the general public for any purpose, when any portion of said structure is constructed or remodeled by or for the purpose of sale or lease to the Government of the Virgin Islands or any agency or instrumentality thereof, independent or otherwise. Only those portions of such buildings as are actually occupied or intended for occupancy by the Government of the Virgin Islands or any of its said agencies or instrumentalities need be so constructed or remodeled as to comply with the provisions of this chapter.
