As used in this chapter, unless the context clearly indicates otherwise:
“Amusement attraction” means any building or structure around, over or through which persons may move or walk, without the aid of any moving device integral to the building or structure, that provides amusement, pleasure, thrills or excitement. The term does not include any enterprise principally devoted to exhibition of agriculture, arts, cultural heritage, education, industry, religion, or science. “Amusement ride” means any mechanical device which carries or conveys passengers along, around or over a fixed or restricted route or course within a defined area, for the purpose of giving it passengers amusement, pleasure, thrills, or excitement, including those amusement rides operating at an amusement attraction. “Commissioner” means the Commissioner of Licensing and Consumer Affairs. “Lessee” means any person who leases an amusement ride or attraction. “Operator” means any person actually engaged in or directly controlling the operation of an amusement ride or attraction. “Owner” means any person who owns an amusement ride or attraction. The term does not include the Government of the Virgin Islands or its political subdivisions. “Qualified inspector” means any inspector from a department or agency of the government designated by the Commissioner.
