(a) Prior to granting professional privileges to or hiring any health care provider, a hospital shall obtain from the health care provider the following information:
(1) The names of any hospital or medical facility with or at which the health care provider had or has any association, employment, privileges or practice.
(2) Any pending professional misconduct proceeding or any pending malpractice action against the person, the substance of the allegations or actions, and any additional information concerning such proceedings or actions as the health care provider may deem appropriate.
(3) The substance of the findings in such actions or proceedings and any additional information concerning such actions or proceedings as the health care provider may deem appropriate.
(4) A waiver by the health care provider of any confidentiality provisions concerning the information required to be provided pursuant to this section.
(5) A verification by the health care provider that the information provided is true and accurate.
(b) Prior to granting privileges to or hiring any health care provider a hospital shall request from any hospital, medical facility, or other former employer of the person, the following information:
(1) Any pending professional medical conduct proceedings or any pending medical malpractice actions.
(2) Any judgment or settlement of a medical malpractice action and any finding of professional misconduct.
(c) If requested by the Commissioner of Health, a hospital shall provide documentation that prior to granting privileges to or employing any health care provider the hospital complied with the requirements of this section.
