  • Every person authorized to construct and operate a publicly owned treatment work shall have the authority to take all action necessary for its efficient and adequate operation in accordance with the requirements and conditions of this chapter and the Federal Water Pollution Control Act, as amended, including but not limited to the authority:
    • (a) To assure that each recipient of waste treatment services within its jurisdiction will pay its proportionate share of the costs of operation and maintenance (including replacement) of any waste treatment services provided.

    • (b) To provide for the payment of it by the industrial users of the treatment works of that portion of the cost of construction of such treatment works which is allocable to the treatment of such industrial wastes to the extent attributable to the federal share of the cost of construction.
