Filing of contracts, forms and rates

  • (a) No contract form nor related form may be issued or used in the territory unless it has been filed with and approved by the Commissioner.

  • (b) Every such filing shall be made not less than 30 days in advance of issuance or use. At the expiration of 30 days from the date of filing, a form so filed shall be deemed approved unless prior thereto it has been affirmatively approved or disapproved by written order of the Commissioner. The Commissioner may extend, by not more than an additional 30 days, the period within which to affirmatively approve or disapprove any such form by giving notice of such extension before the expiration of the initial 30-day period. At the expiration of any such period as so extended and in the absence of prior affirmative approval or disapproval, any such form shall be deemed approved.

  • (c) In addition, each association or insurer shall file with the Commissioner, the rate to be charged for each contract and the premium, including all modifications of rates and premiums, to be paid by the contract holder. Every filing shall state the proposed effective date of the rate to be charged. Such filing shall be made not fewer than 30 days prior to its effective date. No rate or modification of a rate or premium shall be used unless filed.
