  • (a) No member or officer of the National Guard of the Virgin Islands shall be liable, either civilly or criminally, for any damage to property or injury to any person, including death resulting therefrom, caused by him or by his order, while performing any military duty lawfully ordered under any provision of this chapter, unless the act or order causing such damage or injury was manifestly beyond the scope of the authority of such member or officer and except as otherwise provided by section 3408 of Title 33 of this Code.

  • (b) Such attorney's fees, as shall be directed by the courts of the Virgin Islands and court costs incurred in any case against a member or an officer of the National Guard of the Virgin Islands arising out of any act committed in the line of official duty while on active military duty, shall be paid by the Government of the Virgin Islands.
