  • The provisions authorized by section 153 of this chapter in any contract imply conditions that the alcoholic beverages may be resold without reference to such contract in the following cases:
    • (1) In closing out the owners' stock for the purpose of discontinuing delivery of any such alcoholic beverage. At the place of any such sale and upon the alcoholic beverages sold and in any advertisement in connection therewith public notice shall be given of the character of the sale as a close-out sale. The alcoholic beverage shall first be offered to the producer or vendor thereof at the original invoice price at least 10 days before it is offered for sale to the public.

    • (2) When the alcoholic beverage or container is damaged or deteriorated in quality, and notice of this fact is given to the public at the place of any such sale and upon the goods sold and in any advertisement in connection therewith.

    • (3) By any officer acting under orders of any court.
