  • (a) The Virgin Islands Employment Security Agency, as heretofore established as an independent agency of the Virgin Islands within the Office of the Governor is hereby transferred to and made a division of the Department of Labor as provided by Title 3, section 355(a) of the Code, and said Agency shall be under the general supervision and control of the Commissioner of Labor. The Virgin Islands Employment Service heretofore continued by former section 153 of this title, and the Virgin Islands Unemployment Compensation Service (hereby redesignated the “Virgin Islands Unemployment Insurance Service”), heretofore established in the said Virgin Islands Employment Service, are continued and designated as divisions of the Virgin Islands Employment Security Agency.

  • (b) All powers, duties and functions conferred on the Virgin Islands Employment Service heretofore continued by former section 153 of this title, and all property, assets, liabilities, contracts, records, unexpended balances of appropriations, and all personnel and equipment of the same are hereby transferred and continued in the Virgin Islands Employment Service as a division of the Virgin Islands Employment Security Agency.

  • (c) All powers, duties, and functions conferred on the Virgin Islands Unemployment Compensation Service, heretofore established in the Virgin Islands Employment Service by section 312(a) of this title, and all property, assets, liabilities, contracts, records, unexpended balances of appropriations, and all personnel and equipment of the same are hereby transferred and continued in the Virgin Islands Unemployment Insurance Service as a division of the Virgin Islands Employment Security Agency.

  • (d) The Virgin Islands Employment Security Agency division of the Department shall be administered by a full time Director and the subdivisions thereof shall be administered by Assistant Directors, under the supervision and direction of the Director who shall, in turn, be under the supervision and direction of the Commissioner of Labor. The Director, Assistant Directors and other employees of the division shall be appointed pursuant to the provisions of Title 3, chapter 25, of the Code.

  • (e) The Virgin Islands Employment Security Agency, acting through its respective divisions, shall administer the provisions of this chapter and of chapter 12 of this title.

  • (f) The Virgin Islands Employment Security Agency, acting through the Virgin Islands Employment Service, is hereby designated and constituted the agency for the Government of the Virgin Islands for the purpose of the Act of Congress referred to in section 152 of this title with full power and authority to cooperate with all authorities of the United States having powers or duties under the said Act and to do and perform all things necessary to secure to the Virgin Islands the benefits of such Act in the promotion and maintenance of a system of public employment offices.

  • (g) Services rendered by the Virgin Islands Employment Security Agency under this chapter shall comply with the authorizations and regulations of the Bureau of Employment Security of the United States Department of Labor. The Director shall, subject to the supervision of the Commissioner of Labor, be empowered to establish and maintain free public employment offices in such manner and in such plans as may be necessary for the proper administration of this chapter and for the purpose of performing such duties as are within the purview of the aforesaid Act of Congress.
