  • Unless the context otherwise requires, the definitions set forth below and the definitions contained in chapter 1 of this title shall govern the construction of this chapter.
  • “Alcoholic Beverage” includes distilled alcohol, spirits, liquor, wine and every liquid or solid containing alcohol, spirits, wine, and which contains one-half of one per centum or more of alcohol by volume, and which is fit for beverage purposes either alone or when diluted, mixed, or combined with other substances; but shall not include beer wherever produced or alcoholic beverages produced or distilled in the United States Virgin Islands.
  • “Board” means the Virgin Islands Board of Control of Alcoholic Beverages.
  • “Importer” means any consignee of alcoholic beverages brought into the United States Virgin Islands from without the United States Virgin Islands, when the alcoholic beverages are for delivery or use within the United States Virgin Islands.
  • “Licensee” means any person holding a license issued pursuant to chapter 1 of this title.
  • “Producer” means any person subject to the licensing provisions of section 6 of chapter 1 of this title.
  • “Retailer” means any person licensed to sell alcoholic beverages for off-premises consumption pursuant to section 9 of chapter 1 of this title.
  • “Sell” or “sale” and “to sell” includes any transaction whereby, for any consideration, title to alcoholic beverages is transferred from one person to another, and includes the delivery of alcoholic beverages pursuant to an order placed for the purchase of such beverages and soliciting or receiving an order for such beverages, but does not include the return of alcoholic beverages by a licensee to the licensee from whom such beverages were purchased.
