Authority and duties of the Commander-in-Chief

  • The Governor of the Virgin Islands as Commander-in-Chief of the National Guard shall be empowered to:
    • (a) Nominate a qualified resident of the Virgin Islands for appointment as Adjutant General of the Virgin Islands.

    • (b) Order into the Territorial Active Military Service the National Guard of the Virgin Islands National Guard of the Virgin Islands or any part thereof, when the public safety may require.

    • (c) Order and authorize the Adjutant General of the Virgin Islands to adopt standards and regulations for the organization, training, operations and provisioning of the National Guard of the Virgin Islands.

    • (d) Appoint, subject to the approval of the Secretary of the Army and the Secretary of the Air Force, a Commissioned Officer of the Armed Services of the United States and a member of the United States National Guard to be the United States Property and Fiscal Officer.

    • (e) Promulgate such rules and regulations as may be necessary for compliance with the purposes of this Part.

    • (f) Appoint, assign and fix the rank of officers. An officer may be separated for cause or at his own request as provided under the authority of this chapter.

    • (g) Determine from time to time the composition of the units of the National Guard of the Virgin Islands which will be organized as well as the geographical location assigned to the corresponding units.

    • (h) The Commander-in-Chief may delegate to the Adjutant General the powers and duties set forth in subsections (d) through (g).
