5. (Repealed effective October 1, 2021) Persons permitted to work in mines; age requirements

A. No person under eighteen years of age shall be permitted to work in any mine, and in all cases of doubt, the operator, agent or mine foreman shall obtain a birth certificate or other documentary evidence, from the Registrar of Vital Records, or other authentic sources as to the age of such person. The Department shall conform to the federal Fair Labor Standards Act, 29 U.S.C. § 212, and federal regulations adopted pursuant to that Act with respect to persons under 18 years of age working around any mine.

B. No operator, agent or mine foreman shall make a false statement as to the age of any person under eighteen years of age applying for work in or around any mine.
