- Exemptions
Exempted from this chapter are:
- Septic tanks;
- Farm or residential tanks of one thousand one hundred gallons (1,100 gal.) or less used for storing motor fuel for noncommercial purposes;
- Tanks used for storing heating oil for consumption on the premises where stored;
- Pipeline facilities (including gathering lines) regulated under:
- The Natural Gas Pipeline Safety Act of 1968, compiled in 49 U.S.C. Appx. § 60101 et seq.;
- The Hazardous Liquid Pipeline Safety Act of 1979, compiled in 49 U.S.C. Appx. § 60101 et seq.; or
- State laws comparable to the law referred to in subdivision (4)(A) or (4)(B), if it is an intrastate pipeline;
- Surface impoundments, pits, ponds, or lagoons;
- Storm water or waste water collection systems;
- Flow-through process tanks;
- Liquid traps or associated gathering lines directly related to oil or gas production and gathering operations;
- Petroleum storage tanks situated in an underground area (such as a basement, cellar, mine working, drift, shaft, or tunnel) if the storage tank is situated upon or above the surface of the floor; and
- Pipes or connections connected to exempted tanks.
