There is created within the department of labor and workforce development a board of boiler rules, which shall hereafter be referred to as the “board,” consisting of five (5) members who shall be appointed to the board by the governor. The original appointments were one (1) for a term of one (1) year, one (1) for a term of two (2) years, one (1) for a term of three (3) years and two (2) for a term of four (4) years. At the expiration of their respective terms of office, they, or their successors identifiable with the same interest respectively as provided in this section, shall be appointed for terms of four (4) years each. The governor may at any time remove any member of the board for inefficiency or neglect of duty in office. Upon the death or incapacity of any member, the governor shall fill the vacancy for the remainder of the vacated term with a representative of the same interest with which the representative's predecessor was identified. Of these five (5) appointed members, one (1) shall be representative of owners and users of boilers within the state, one (1) shall be representative of the boiler manufacturers within the state, one (1) shall be a representative of a boiler insurance company licensed to do business within the state, one (1) shall be a mechanical engineer on the faculty of a recognized engineering college or a graduate mechanical engineer having equivalent experience, and one (1) shall be representative of the boilermakers or practical steam operating engineers. In making appointments to the board, the governor shall strive to ensure that at least one (1) person serving on the board is sixty (60) years of age or older and that at least one (1) person serving on the board is a member of a racial minority. The board shall elect one (1) of its members to serve as chair, and, at the call of the chair, the board shall meet at least four (4) times each year at the state capitol or other place designated by the board. Beginning July 1, 1965, the membership of the board shall be increased by one (1) member who shall be a representative of the owner-users of unfired pressure vessels and who shall be a mechanical engineer licensed to practice in the state of Tennessee. Such additional representative's appointment shall be made by the governor. The additional representative's first term shall be for a period of two (2) years and all succeeding terms after the expiration of the first shall be for a period of four (4) years.
The members of the board shall serve without salary and shall be reimbursed for travel expenses in accordance with the comprehensive travel regulations as promulgated by the department of finance and administration and approved by the attorney general and reporter.
